Lawyers remind that according to Art. 248 of the Criminal Code, a person who voluntarily surrendered firearms, ammunition, explosives and explosive devices (hereinafter referred to as weapons) is exempt from liability.
A person is considered to have voluntarily surrendered a weapon, if he himself applied to the internal affairs bodies for surrender. A person is not considered to have voluntarily surrendered a weapon if it came to a decision to surrender the weapon during a search or as a result of bringing evidence of the possession of weapons. Therefore, such person is held liable.
A person who has expressed a desire to voluntarily surrender the weapon must contact the territorial body of internal affairs or the preventive inspector at the location of the weapon verbally or with a written application.
